Selling custom avatar FBX to a customer?

Hello. Under terms of the EULA, is it permitted to sell a customer an avatar exported as FBX and made to their likeness using Headshot 2?
I assume use of props or assets in the model would complicate what can be used?

Under the terms of the EULA you are only permitted to sell characters in the Reallusion Stores. Selling in 3rd party stores is not permitted.

However, you are permitted to take on commissioned work for clients providing the guidelines are followed.

So for example, if your client plans to use the character you have created in a commercial game, then you will need to have purchased the required Extended license for any purchased content used in the creation of the character.

In addition, if you are supplying the project files in Reallusion’s proprietary formats to the client, then the client will also need to have the requires licenses to use the content.

But if the character is not be used in a commercial game or app, and only used for imagery purposes (rendered videos or photos) then no additional license requirements are needed.

Hello Pete, thank you. In terms for such work, than I will specify use cases as partof the TOS (no reselling). I will read this section of your EULA. I assume legal use in gaming might also include use in social sites like VRChat and “metaverse” environments?

Do you have a page that is more explicit with MANY examples scenarios, so that there is no confusion here? Then you don’t need to answer questions, but rather just point us to a single page that fully explains it explicitly with full clarity.

“Yes it does” means that VR chat and metaverse are classified as video games. So it’s possible to use Reallusion assets in them.

Generally, a character select screen in video games is fine. If you are able to change the look of a video game character it’s no longer a character select but a character generator.

If you use your own assets you can do with them what you want.

If you use Reallusion assets you cannot use them in a character generator and cannot sell them outside the Reallusion store or print 3D action figures of them.

For this you need to negotiate an enterprise license with Reallusion were you perhaps need to pay upfront or pay royalties for each item sold.

And if you work as a freelancer and a client commissions a 3D model from you, you cannot sell them the original Reallusion assets, only an exported file like FBX.

So my answer means yes you can use Reallusion content in VRChat and the Metaverse providing you have purchased the appropriate license for any purchased content used.
